Please read carefully these Terms of Use (“Terms”) before using the services offered by "Face Swap Video: Deep Fake". These Terms constitute a legally binding agreement between "Face Swap Video: Deep Fake". (also Face Swap Video: Deep Fake, “we”, “us”) and User (also “you”, “your”), which regulates your use of the "Face Swap Video: Deep Fake" mobile application (“Application”) and other services as provided herein.
THESE TERMS OF USE INCLUDE BINDING ARBITRATION CLAUSE IN CHAPTER 14 BELOW. PLEASE READ CAREFULLY.
By downloading from the Apple App Store or other platform, installing the application or ticking the respective box in the form on the application, you agree to be bound by these Terms and "Face Swap Video: Deep Fake" Privacy Policy (“Privacy Policy”). Your downloading of the application from the Apple App Store or other platform is also governed by the respective terms of use and other accompanying documents of Apple App Store or other platforms.
If "Face Swap Video: Deep Fake" provides you with the Services through the website, you agree to be bound by these Terms and the Privacy Policy by using the website. If you do not agree to these Terms, do not access or use our Services.
"Face Swap Video: Deep Fake" is an online face swap application that uses artificial intelligence algorithms to generate unique content (“Services”). You may use "Face Swap Video: Deep Fake" immediately with no registration form being submitted.
Some Subscription Plans may be available for specific digital marketplaces only. "Face Swap Video: Deep Fake" in its sole discretion determines which Subscription Plans will be available on the respective digital marketplace. The fee of each Subscription Plan will be displayed in the Application.
The subscription period starts immediately after the initial subscription payment is processed. Unless otherwise mentioned in the Application, your subscriptions will be renewed automatically and the term of and the fee applicable to the initial subscription shall apply to such renewed subscription. Should you decide to cancel your subscription, please check the instructions at Google Play Store /App Store support pages.
You will not receive a prorated refund when you cancel the subscription. You will continue to have the access to the PRO Features until the end of the prepaid period of the respective Subscription Plan. Following the cancelation of the subscription, you will still be obligated to pay other charges incurred by you during the use of the PRO Features prior to the cancellation date.
Free trial period: We offer you three days of free trial within the Annual Subscription Plan and 3 Months Subscription Plan. Weekly Subscription Plan and Monthly Subscription Plan have no trial period. The exact terms of the trial period will be displayed in the Application at the moment when you activate the Annual Subscription Plan. Unless you cancel the Annual Subscription Plan or 3 Months Subscription Plan 24 hours before your free trial period expires, "Face Swap Video: Deep Fake" will charge your subscription fee automatically.
Pricing and Payments: The fee and other terms of the Subscription Plans may be revised by us from time to time in our sole discretion. "Face Swap Video: Deep Fake" will notify you of changes to the fee and other terms of the Subscription Plans reasonably in advance of their effective date. You may cancel your subscription if you do not accept the fee and other terms of the Subscription Plans as revised by us. Subject to applicable law, you accept the revised fee and other terms of the Subscription Plans by continuing to use the Services after such revised fee and other terms of the Subscription Plans become effective.
By activating a Subscription Plan, you confirm and acknowledge that your subscription will be automatically renewed and, unless you cancel your subscription or free trial period (as applicable) within the term that excludes automatic charging of applicable subscription fee, you authorize us to charge your payment method for the renewal term. The payment should be performed via the method and in the amount indicated in the Application for the respective Subscription Plan at the time of the purchase. You are responsible for payment of all fees, charges and taxes (if required by applicable law) applicable to the transaction.
Refunds: Your fees paid to "Face Swap Video: Deep Fake" may be refunded if required under the applicable laws or according to refund terms of Google Play Store and App Store. Also, you are eligible for a refund within 48 hours after we validate your purchase, only in the case when you are dissatisfied with Services due to bad quality of face swapping. In any case, this refund guarantee is not applicable to renewals of subscriptions.
Scope of the Services: "Face Swap Video: Deep Fake" reserves the right to change the Services scope listed herein and change/introduce prices and fees applicable to the Services at any time for any reason in its sole discretion and without notice. "Face Swap Video: Deep Fake" is entitled to stop or restrict provision of the Services in full or in part toward a certain user. "Face Swap Video: Deep Fake" retains powers to discontinue provision and/or support of the Services without any prior notice.
You must be at least 12 years of age to access or use our Services. If you are under 18 years of age (or the age of legal majority where you live), you may only access or use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian of a user under the age of 18 (or the age of legal majority), you agree to be fully responsible for the acts or omissions of such user in connection with our Services.
By using the Services, you state that: you can form a binding contract with "Face Swap Video: Deep Fake", meaning that you either are over the age of 18 or you use the Services under a parent’s or legal guardian’s supervision; you are not a person barred from using the Services under the laws of the United States, the European Union (including the laws of the EU member states) or any other applicable jurisdiction; you will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.
Our Services and the text, graphics, images, illustrations, trademarks, trade names, page headers, button icons, scripts, and other content contained therein are owned by "Face Swap Video: Deep Fake" or its subsidiaries or affiliated companies and is protected by copyright, patent, trade secret, and other intellectual property laws. Except as explicitly stated in these Terms, "Face Swap Video: Deep Fake" reserves all rights in and to our Services.
We hereby grant you a limited, worldwide, royalty-free, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services. This license is for the sole purpose of letting you use and enjoy the Service's benefits in a way that these Terms allow.
Such license does not include any right to: (a) sell or commercially use any part of our Services; (b) copy, reproduce, distribute, publicly perform or publicly display any part of our Services; (c) modify any part of our Services, remove any proprietary rights notices; (d) reverse engineer or attempt to extract the source code of that software; or (e) use our Services other than as expressly provided in these Terms. The license does not cover any GIFs or videos possessed by any third parties and used by "Face Swap Video: Deep Fake" to provide the Services. You shall use them as stipulated in chapter 4 hereof.
Our Services may contain links to third-party websites or services that we don’t own or control (for example, links to Facebook, Twitter, YouTube). You may also need to use a third-party's product or service in order to use some of our Services (like a compatible mobile device to use our mobile apps). When you access these third-party services, you do so at your own risk. The third parties may require you to accept their own terms of use. "Face Swap Video: Deep Fake" is not a party to those agreements; they are solely between you and the third party.
Users of our Services may upload, submit, store, send or receive content (“Your Content”). Users own and retain any rights that they already hold in Your Content. Users of our Services agree to the following:

"Face Swap Video: Deep Fake" DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT FROM TIME TO TIME "Face Swap Video: Deep Fake" MAY REMOVE THE SERVICE FOR INDEFINITE PERIODS OF TIME OR CANCEL THE SERVICE AT ANY TIME, WITHOUT NOTICE TO YOU.
"Face Swap Video: Deep Fake" SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
IN NO EVENT WILL "Face Swap Video: Deep Fake", ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT "Face Swap Video: Deep Fake" HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless "Face Swap Video: Deep Fake", its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including, without limitation, attorneys’ fees, arising from or relating in any way to your use of our Services, your violation of these Terms, your violation of any law or the rights of any third party, or any claim or damages that arise as a result of any of Your Content that you provide to our Services.
"Face Swap Video: Deep Fake" reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our Services.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.
You agree that any dispute or claim arising out of or relating to these Terms or your use of the Services will be resolved exclusively by arbitration, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted in English, in the city of Wilmington, Delaware, USA, by one arbitrator appointed in accordance with the American Arbitration Association rules. The arbitration shall be conducted on a confidential basis.
If you are a resident of the European Union, you may bring proceedings against "Face Swap Video: Deep Fake" in the courts of the country where you live. If you are a resident of any other country outside the United States and European Union, you may bring proceedings against "Face Swap Video: Deep Fake" in the courts of the State of Delaware, USA. You also consent to the jurisdiction of the courts of the State of Delaware, USA.
